Toronto – 2008 – Justice George Strathy of the Superior Court of Justice has ruled that the requirement for Justices of the Peace to retire at age 70 is unconstitutional.  Justice Strathy ruled that the differential treatment of Justices of the Peace and Ontario Court Judges is not justified.  Justice Strathy has directed that the provisions of the Justice of the Peace Act of Ontario dealing with retirement be “read down” and be given the same meaning as that in the Courts of Justice Act relating to judges which provides that justices may work until age 75.
